Six Filipinos including one female involved in “online pharmacy” were nabbed by the PNP Anti-Cybercrime Group’s Cyber Response Team (CRT) together with elements of PRO3 Regional and Tarlac Public Safety Company during operations in No. 14 F, Timbol Street, San Jose, Concepcion, Tarlac, Sunday.

The arrest of the six Filipinos was by virtue of the warrant issued by Honorable Acting Presiding Judge, LYLIHA L. ABELLA-AQUINO, RTC, Branch 24, of the City of Manila.

The suspects were nabbed for violating RA 8484 (Access Devices regulation Act) in Relation to Section 11 Subsections (k) of RA No. 3720 as Amended by RA No. 9711 otherwise known as “Food and Drug Administration (FDA) Act of 2009″.

They were identified as Ryan Artzen Poblacio, John Poblacio, Fred Panuncio, Noelito Asuncion, Allan Abarquez and Joan Serrano.

Seized from their possession and control were assorted bank passbooks, assorted documents, identification cards, assorted mobile phones, laptops, network devices, desktop computers, assorted cards believed to be used in their illegal activities.  Further several items incidental to the lawful search were confiscated such as: sachet containing suspected residue of shabu, foil, pipe, short firearms (caliber .45 and .38) with ammunitions, empty shells, air gun rifle, one (1) shotgun and a hand grenade.

PNP ACG Director PSSUPT GILBERT C SOSA said that the operation stemmed from the reports received by the office about the growing and prevalent problem in the distribution of counterfeit and/or generic drugs globally and locally which were likewise placed in advertisements in various internet business to business forums and through online pharmacy websites being catered by Atzen Global Service Incorporation (AGSI).

Investigation further disclosed that AGSI is not authorized and/or has no license to sell, offer for sale, distribute, transfer of drugs from the Food and Drugs Administration, (FDA) as confirmed per letter dated July 12, 2013.

The six are now under the custody of PNP ACG prior to filing of criminal case before the Prosecutor’s Office through inquest proceedings.

Cases for Violation of Ra 8484, Section 11 Subsection (k) of RA No. 3720 as amended by RA No. 9711; RA 9516  (Amending Section 3 & 4 of PD 1866); Section 11 & 12 of RA 9165 (Comprehensive Dangerous Drugs Act of 2002); and Section 12. 2 of RA 10591 (Comprehensive Firearms & Ammunitions Regulation Act) are being readied against RYAN ARTZEN POBLACIO, while Cases for violations of PD 1829 (Penalizing Obstruction of Apprehension and Prosecution of Criminal Offenders) and RA 10591 are being readied against the Security Guard NOELITO ZABALA ASUNCION; and a Case for Violation of Ra 8484, Section 11 Subsection (k) of RA No. 3720 as amended by RA No. 9711 is being readied against the remaining four (4) arrested suspects.

The PNP Anti-Cybercrime Group on the instruction of the Chief PNP will continue to focus their operation on transnational organized cybercrime groups.
